(Garrison, NY) Arguing that obesity "may be the most difficult and elusive public health problem the United States has ever encountered" and that anti-obesity efforts having made little discernible difference, Daniel Callahan, co-founder and President Emeritus of The Hastings Center, proposes a bold and controversial approach to fighting the epidemic.

Callahan says that the public health community can learn from one of the most successful public health campaigns: the anti-smoking campaign. A primary strategy has been to stigmatize smokers, he says, making it clear that their behavior is not only unhealthy for them but is also socially unacceptable. While the public health community has decisively rejected the stigmatization of obesity, Callahan directly challenges that rejection.

In "Obesity: Chasing an Elusive Epidemic," an article in the Hastings Center Report, Callahan says that what he calls "stigmatization lite," if used carefully, could provide an important strategy in the strikingly unsuccessful effort to help the 67 percent of Americans who are overweight or obese lose weight. He cites estimates that no more than 10 percent of those who try to lose weight succeed in the long run.

Callahan does not deny that stigmatization can do harm, such as increasing the risk of discrimination in the workplace and health care. But he believes that that risk would be minimized by "stigmatization lite," in which people who are overweight consider the threat of discrimination itself as a danger to be avoided: "don't let this happen to you!" His aim is to complement, not replace, public health strategies that would bring to bear a strong government hand, making use of laws and regulations and subsidizing healthy foods, good medical counseling, and special efforts at obesity prevention programs for children.

I made this fruit salad for a few friends that came over for dinner. I served it as a dessert,?although it could easily be served anytime of day ? especially for breakfast or a snack.

FOOD BABE?S CHIA SEED FRUIT SALAD

Serves: 4

  • ? cup chia seeds
  • 2 cups nut milk of your choice
  • 4 cups of diced fruit of your choice (for this recipe I used pears and strawberries)
  • ? cup currants or raisins or goji berries
  • zest of one orange
  • juice of one orange
  • 1 tbsp vanilla
  • ? tsp cinnamon
  • ? cup shredded coconut
  • mint leaves for decoration
  1. Add 1 cup diced fruit and a sprinkle of currents to 4 different bowls
  2. Combine nut milk, chia seeds, orange juice, zest, vanilla and cinnamon in a small pitcher and stir
  3. Pour ? cup mixture on top of fruit in bowls
  4. Top fruit bowls with shredded coconut
  5. Refrigerate fruit bowls for at least 30 mins (or chill overnight)
  6. Top each bowl with a mint leaf before serving

George Will explains in today?s Washington Post that Chief Justice John Roberts may have temporarily rescued Obamacare by finding it to be constitutional, but by limiting the penalties for not buying health insurance, he may have made the Affordable Care Act (ACA) unworkable and put it on a path to ultimate extinction. Here?s why:

The point of the penalty to enforce the [health insurance] mandate was to prevent healthy people ? particularly healthy young people ? from declining to purchase insurance, or dropping their insurance, which would leave an insured pool of mostly old and infirm people. This would cause the cost of insurance premiums to soar, making it more and more sensible for the healthy to pay the ACA tax, which is much less than the price of insurance.

Chief Justice John Roberts noted that a person earning $35,000 a year would pay a $60 monthly tax and someone earning $100,000 would pay $200 per month. But the cost of a qualifying insurance policy is projected to be $400 a month. Clearly, it would be sensible to pay $60 or $200 rather than $400 per month, because if one becomes ill, ?guaranteed issue? assures coverage and ?community rating? means that one?s illness will not result in higher insurance rates.

But Roberts?s decision limits Congress?s latitude by holding that the small size of the penalty is part of the reason it is, for constitutional purposes, a tax. It is not a ?financial punishment? because it is not so steep that it effectively prohibits the choice of paying it. And, Roberts noted, ?by statute, it can never be more.? ?.the penalty for refusing to purchase insurance counts as a tax only if it remains so small as to be largely ineffective.

Because the penalties are constitutionally limited by the reasoning whereby Roberts declared them taxes, he may have saved the ACA?s constitutionality by sacrificing its feasibility. So as the president begins his second term, the signature achievement of his first term looks remarkably rickety.

(AP) ? Five months after he ended a 76-year drought for British men in Grand Slam tournaments with a win at the U.S. Open, Andy Murray is into the quarterfinals at the Australian Open and on track to make it two in a row.

The third-seeded Murray easily beat Gilles Simon of France 6-3, 6-1, 6-3 on Monday for his fourth straight-sets win in a row. He will play unseeded Frenchman Jeremy Chardy in the quarterfinals.

Simon, coming off a tough five-set win over fellow Frenchman Gael Monfils, clearly wasn't in any shape to challenge Murray.

"After the first few games, I mean, it didn't feel like that competitive," Murray said. "Sort of at this stage of a Grand Slam you're sort of gee'd up and prepared for a tough battle. That's why it becomes hard because the emotions aren't quite into it."

Serena Williams had a similarly easy time advancing to the quarterfinals and a chance to win her third major in a row with a 6-2, 6-0 win over Maria Kirilenko. She's still on course for a potential semifinal meeting with defending champion Victoria Azarenka, who advanced with a 6-1, 6-1 victory over Elena Vesnina.

"I didn't expect to come out and play so well tonight," Williams said. "I was like 'Wow!' I saw I had 95 percent first serves in the first set. I said 'Who is this girl?' It's not me usually."

Williams has lost only one match since her first-round exit at the French Open last year. Since then, she has won Wimbledon, Olympic gold, the U.S. Open, the season-ending WTA championships and a Brisbane International title.

Her 57-minute win over Kirilenko extended her current winning streak to 20 matches.

The 31-year-old Williams can become the oldest woman to hold the No. 1 ranking by winning her sixth Australian Open title. She next plays 19-year-old American Sloane Stephens, who reached the quarterfinals at a major for the first time with a 6-1, 3-6, 7-5 win over Bojana Jovanovski of Serbia.

Second-seeded Roger Federer, who could meet Murray in the semifinals, was playing Canadian Milos Raonoic in the second night match on Rod Laver Arena.

Chardy followed his upset of 2009 U.S. Open champion Juan Martin del Potro with a 5-7, 6-3, 6-2, 6-2 win over another highly-ranked player, No. 21 Andreas Seppi, in the fourth round.

Another Frenchman to advance was seventh-seeded Jo-Wilfried Tsonga, who beat friend and compatriot Richard Gasquet 6-4, 3-6, 6-3, 6-2 in the fourth round.

Tsonga, who lost the 2008 Australian Open final to top-ranked Novak Djokovic, could meet Roger Federer in the quarterfinals if the 17-time Grand Slam champion beats Canadian Milos Raonic later Monday at Rod Laver Arena.

Waiting on the other side of the draw is Djokovic, who could meet Federer or Murray in the final and plays his quarterfinal match Tuesday against Tomas Berdych. Djokovic advanced to the quarters after a 5-hour, 2-minute fourth-round win over Stanislas Wawrinka in the early hours Monday.

Azarenka's fourth-round win was as impressive as Williams'.

"It's getting there ... with every match you start building up for the top battles starting now," said Azarenka, who needed only 57 minutes to beat the 47th-ranked Vesnina. "It's really exciting to be again so far in the tournament."

Azarenka started last season with a 26-match winning streak, including a lopsided victory over Maria Sharapova in the Australian Open final. She moved to No. 1 in the rankings with that win and has remained there for all but a few weeks ever since.

But she needs to defend her Australian title to prevent French Open champion Sharapova or Williams from claiming No. 1.

Next up for Azarenka is a quarterfinal against Svetlana Kuznetsova, who entered the season's first major ranked No. 75 but has won titles at the 2004 U.S. Open and 2009 French Open.

After five breaks of serve in the third set, Stephens broke Jovanovski and then held to advance ? knowing her parents and grandparents were watching on TV.

"I'm sure my mother's had like four heart attacks," Stephens joked after the see-saw match. "I hope my Grandpa didn't have to put my Grandma to bed, because she gets a little worried."

Williams, who has rated Stephens a potential world No. 1, beat the 19-year-old American in straight sets two weeks ago at the Brisbane International, one of the warm-up tournaments for the Australian Open.

Stephens is looking forward to a rematch, where there won't be any major surprises.

"It will be tough, obviously ... it's quarters of a Grand Slam," she said. "There won't be that like first time, 'Oh, my God, I'm playing Serena'. That's kind of out of the window now. So that's good. And then it will feel more of like a regular match instead of all the other like things to think about."

Kuznetsova was given a time warning for taking too long during a changeover in her 6-2, 2-6, 7-5 win earlier Monday over former No. 1 Caroline Wozniacki, but said it didn't bother her.

As for Wozniacki, after twice failing to win her breakthrough major as the No. 1-ranked woman at the Australian Open, she is now expected to drop out of the top 10 after a fourth-round loss that follows back-to-back first-round exits at Wimbledon and the U.S. Open.

Kuznetsova is moving in the other direction on her comeback from a right knee injury that ruled her out of the last U.S. Open, ending a run of contesting 40 consecutive majors. And she's looking forward to taking on Azarenka.

"The time I played in Indian Wells was totally a disaster. I got (beaten) very badly," she said. "But, I mean, she's tough. She's No. 1. I have nothing to lose. She has all the pressure.

"I know I got the game to give her some problems, and I will just do my best and just try to enjoy it."

Advantages of imaginary friends

Jan. 7, 2013 ? Most parents do not worry if their young child has an imaginary friend and even see advantages in such an invisible companion.

These are the findings to be presented 10 January 2013, at the Annual Professional Event of the British Psychological Society's Division of Educational and Child Psychology. The event is being held at the Grand Thistle Hotel, Bristol.

Dr Karen Majors Chartered Educational Psychologist, Barking and Dagenham Educational Psychology Service and Dr Ed Baines, Senior Lecturer in Psychology from the Institute of Education, collected 265 questionnaires from parents about their children's imaginary friends.

The great majority of the parents (88 per cent) answered that they did not think that there were disadvantages for their child in having an imaginary friend. Parents saw the main reasons for having invisible friends as supporting fantasy play and as a companion to play and have fun with. Parents also gave numerous examples of how invisible friends helped their children process and cope with life events.

Younger children also used their interactions with invisible friends to test their parents' reactions to behaviour that might be disapproved of, thus helping them learn to regulate their behaviour..

The results also showed that children were more likely to have same-sex imaginary friends, with boys particularly likely to have other boys as invisible companions.

Dr Karen Majors says: "Our results showed that imaginary friends provided an outlet for children's imagination and story making, facilitating games, fun and companionship. These versatile friends also enabled them to cope with new life events like moving house or going on holiday. Above all, these findings remind us just how imaginative children are, which is something we should be pleased about."

VivoPlay packs WiFi, GPS and a GSM connection for tracking, calling your kids

If you're not keen on giving your little tyke the latest and greatest in terms of smartphones, but still want them to be a call away, the VivoPlay could fit the bill. Evado Filip US, the company behind the device, is packing GPS, WiFi and a GSM connection into a wristwatch form factor, which it claims is the world's smallest communications and location device for helping families stay in touch. Parents can call the device and chat with kids and even give their rug rats the option to call up five pre-selected phone numbers. If a child were to wander away with the VivoPlay on their wrist, parents are alerted if they leave or enter a geofenced area and can pinpoint them on a map via a smartphone app. Were a youngster to find themselves in an emergency, they can hit a button that will ring up to five predefined numbers and report their location. The idea sure is a noble one, and the devices we saw looked more than child-friendly. Evado Filip reps told us that the device is being crafted with just that in mind, and the chunky rubber enclosing the communicator sure bears that out. The charger is enclosed for that reason as well, offering a decent bit of protection from the elements (and from childhood).

The metric system is not arbitrary. There is only one unit each of length, mass, volumes, etc. It is also coherent.

The concept of coherence was only introduced into the metric system in the third quarter of the nineteenth century; in its original form the metric system was non-coherent - in particular the litre was 0.001 m3 and the are (from which we get the hectare) was 100 m2. A precursor to the concept of coherence was however present in that the units of mass and length were related to each other through the physical properties of water, the gram having been designed as being the mass of one cubic centimetre of water at its freezing point."

Hitting a high Note: 'phablets', chips to drive Samsung fourth quarter profit

SEOUL (Reuters) - Samsung Electronics, the world leader in mobiles and memory chips, likely earned a quarterly profit of $8.1 billion, as it sold close to 500 handsets every minute and as demand picked up for the flat screens it makes for mobile devices, including those for rival Apple Inc products.

That run of five straight record quarters may end in January-March on weak seasonal demand, though a strong pipeline of smartphones - the South Korean group's biggest earner - and improving chip prices have eased concerns that earnings growth could slow this year, powering Samsung shares to record levels.

"Guidance is unlikely to disappoint given new product launches and a further upturn in cyclical parts of the business," said Morgan Stanley analyst Shawn Kim. "Smartphone momentum has not decelerated, despite Apple's new iPhone, and the business continues to be driven by its flagship products.

"This time, it's the Galaxy Note II ... with the upside in unit shipments mainly from the U.S. We expect strong momentum to continue in the first quarter."

While Apple rolled out just a single new smartphone, the iPhone 5, last year globally, Samsung bombarded the market with 37 variants tweaked for regional and consumer tastes, from high-end smartphones to cheaper low-end models. By comparison, Taiwan's HTC Corp released 18 models, Nokia 9 and LG Electronics 24.

Samsung, valued at close to $230 billion, gives its October-December earnings guidance on Tuesday before the market opens. The full earnings release is expected by January 25.

A HIGH NOTE

Shipments of Samsung's flagship Galaxy S III, which overtook the iPhone 4S in the third quarter to become the world's best-selling smartphone, are likely to have slipped to around 15 million in the last quarter from 18 million in July-September. But estimated sales of around 8 million Galaxy Note II phone-cum-tablets, or 'phablets', should more than make up for that - pushing overall smartphone shipments to around 63 million, analysts estimate.

There has been increased speculation that Samsung will launch the next version of its Galaxy S in the first quarter, possibly with an unbreakable screen and full high-definition quality resolution boasting 440 pixels per inch, as well as a better camera and a more powerful processor.

"Samsung's smartphone shipments are likely to grow even in a seasonally weak first quarter. The early launch of the Galaxy S IV would drive second-quarter growth momentum," said BNP Paribas Securities analyst Peter Yu, who predicts Samsung's 2013 operating profit will grow 25 percent to almost $35 billion.

Samsung is forecast to raise its smartphone sales by 35 percent and widen its lead over Apple this year, driven by its diversified product line-up, said Neil Mawston, Executive Director at market researcher Strategy Analytics, which forecasts Samsung will sell 290 million smartphones this year, up from a projected 215 million in 2012.

Apple's smartphone sales are projected to reach 180 million this year, up by a third from last year's 135 million.

STRONG NUMBERS

Samsung is likely to say on Tuesday that its October-December operating profit increased 65 percent to 8.7 trillion won from a year ago, a Reuters survey of 16 analysts showed. That would be 7 percent higher than its previous record of 8.1 trillion won in July-September.

Profits from the mobile division are seen slightly higher, at around 5.8 trillion won, than the previous quarter's 5.63 trillion won - and more than double last year's level. A recovery in chip prices and flat screens may have also boosted its component earnings, propelled by booming sales of mobiles carrying Samsung's chips, micro-processors and flat screens.

Reflecting the upbeat outlook, shares in Samsung, Asia's most valuable technology stock, last week hit a life high of 1.584 million won ($1,500). The stock gained 44 percent in 2012, easily outpacing a 9 percent rise on the broader Korean market and topping Apple's 31 percent increase.

The shares eased a third of one percent on Monday.

Samsung, LG Electronics and four Taiwan companies were last week fined millions of dollars for allegedly manipulating liquid crystal display panel prices in China in 2001-06, the state-run news agency Xinhua reported.

The current real estate market is marked with low home prices and interest rates ? providing the perfect opportunity for purchasing real estate. Couple these low home prices and interest rates with a decent number of distressed properties (foreclosures, short sales, etc.) on the market, and what we have is an investor?s dream. In short, the current real estate market is incredibly appealing to investors and potential home buyers and as a result these discounted properties are quickly leaving the market.

Now that consumer confidence is rising ? as the real estate market makes progress toward recovery and the nation?s economic state starts to improve ? many investors and home buyers are snatching up distressed properties from the market at record speed.

Therefore, if you are looking for great foreclosure deals, then the time is now ? the shadow inventory is quickly declining and the number of foreclosure filings is decreasing.

Declining Shadow Inventory

What, exactly, is the shadow inventory? In short, the shadow inventory includes the number of homes that will more than likely hit the market as a result of foreclosure in the near future. This number is calculated based on the number of homes at some stage of the foreclosure process, including homes with significantly delinquent mortgages.

In October of 2011, the shadow inventory was 2.6 million; however, according to a recent report by CoreLogic the shadow inventory dropped to 2.3 million in October of 2012. The declining shadow inventory is more than likely due to not only high investor demand for distressed properties, but also the foreclosure settlement agreement that has pushed many lenders to promoting short sales and providing home loan modifications.

A declining shadow inventory is great news for real estate market progress, but is also indicative of fewer foreclosures in the pipeline and therefore fewer opportunities for investors to obtain distressed properties below market value.

Foreclosure Filings Decrease

Along with the declining shadow inventory, the number of foreclosure filings has also decreased 19% from November 2011 to November 2012. Although many states are starting to see significant signs of real estate market recovery (higher home prices, lower foreclosure filings, increased home sales, etc.), other states are still struggling.

For example, Florida?s recovery has been significantly delayed as a result of the state?s lengthy judicial foreclosure process. However, the state?s economy is also linked to new construction which tanked throughout the real estate market crash. As a result, the state has completed over 400,000 foreclosures over the last 5 years, which does not include the homes within the state that are currently at some stage of the foreclosure process.

In conclusion, the real estate market is making strides toward recovery and discounted properties are becoming harder to find. However, although incredible deals on distressed properties are becoming harder to find (due to high demand, a smaller shadow inventory, and lower number of foreclosure filings) ? and will more than likely continue to become more difficult of find throughout the foreseeable future ? there are still several states that are known for their great foreclosure deals.

After 16 years as a mainstay on Main Street, Dolce Vita Italian Restaurant has closed.

In what they described as a ?difficult and heart-wrenching? decision made just before Christmas, owners Rick and Susan Crippen? served the last meals and poured the last glasses of wine on Dec. 29.

Dolce Vita ? Italian for ?sweet life? ? opened in 1996. Rick Crippen began working there in 1999. In 2004, Rick and wife Susan purchased the restaurant.

A few days after closing, the Crippens said down amidst piled tables, empty wine racks and a darkened bar to discuss what lead to their decision. What they described was a perfect storm of debilitating circumstances.

?The construction on Main Street had a terrible impact on our business? Susan said of the 2010 Downtown Uplift renovation project. The construction, occurring at the outset of a general economic downturn, led to a reduction in business in which the restaurant never recovered.

?For about six months we had nobody coming in,? Susan said citing the inaccessibility to Main Street, a resulting lack of visibility and parking issues. ?The mindset during the uplift was that going downtown was not worth the hassle.?

?We were running a business off of six months of income instead of 12, but we still had 12 months? worth of overhead,? she added.

Coming as it did on the heels of a regional energy downturn and recession, completion of the project ? which replaced aging water pipes and made aesthetic improvements to Main Street ?didn?t bring with it the return of customers.

?We lost them with the construction. And with the economy the way it was, they didn?t come back? said Rick, adding that 2008 and 2009 were the best years for the restaurant.

Parking was seen as a major impediment to doing business downtown, even before the construction. The Crippens said they?d received or heard numerous complaints about parking despite the construction of a nearby parking garage.

Susan said many people, especially older customers, are wary of using the parking structure. ?A lot of folks have complained to us that it?s complicated, the machines don?t give change, they?re not easy to read and so forth.? She also cited safety concerns. ?Unfortunately, many people simply did not feel the garage was safe, especially in the dark.?

But other issues also factored into the decision to close Dolce Vita.

?We were seeing more impact from more taxes; more state, local and federal regulations; more infringements on employer?s rights, you name it,? Rick said.

Susan, who managed the finances of Dolce Vita and was until the closure of the restaurant the local representative to the Colorado Restaurant Association, agreed. ?We were seeing increased payroll taxes, utility taxes, sales taxes, unemployment tax,? she said. ?We were also seeing more and more regulations each and every year coming from the food industry responding to government requirements.?

The Crippens also blamed increasing costs. ?All of our input costs were going up,? Susan said, noting the rise in food prices, especially for dairy products. ?Our dairy costs went up 48 percent in the last six months.?

The fact both of them earned income from the same source made the situation even more difficult for the Crippens. Said Rick: ?Both of us earn our money from this restaurant, so we can?t rely on the others? income to help us through hard times.?

Despite his many years in the restaurant industry and other ups and downs in the energy economy, Rick said this is the toughest business environment he?s ever encountered.

Still, neither Susan nor Rick are bitter. Although saddened a business that encompassed their lives for eight years has come to an end, they said they cherish the friends they?ve made along the way and remain proud of their impact on the community.

?This was not just a restaurant. It was our home, our life, our passion,? Susan said. ?We have seen people hold their wedding receptions, celebrate births, first homes, graduations, even hold wakes for beloved family members. This was a family atmosphere, and we regarded our customers as family.?

Susan said she mourns the greater loss to the community from losing a small businesses. ?Small business in any town is a tapestry of who we are ?. It is what distinguishes us from Durango or Aspen? or Canyon City.? Moreover, small businesses are often the largest donors to local causes, she said. ?When we were doing well, we would donate to just about every cause that approached us, from local charities to schools.?

In the end, it was a combination of factors that led to the difficult decision to close Dolce Vita ?We know the construction had to happen, the pipes had to get fixed. We just wish that the timing was better,? Susan said.

Added Rick: ?We did all we could to get people back in the door. But at the end of the day, restaurant money is disposable income, and people just don?t have that now.?

Apple acknowledges Do Not Disturb bug, says it will magically fix itself on January 7th

Well, it's no "you're holding it wrong," but we can't say we're 100 percent satisfied with Apple's response to the recent discovery of a bug affecting iOS's Do Not Disturb feature. Starting January first, ringers failed to turn back on after the predetermined silent period. Today Cupertino seemed to acknowledge the existence of the flaw but, rather than offer a patch, it simply told customers to be patient:

"Do Not Disturb scheduling feature will resume normal functionality after January 7, 2013. Before this date, you should manually turn the Do Not Disturb feature on or off."

Understandably, it'll probably take longer than five days to find the offending code, whip up a fix, test it and roll it out to users. Still, a thorough explanation is always appreciated and the iOS faithful have already been patient enough.
